After browsing for PGs on Blossom Stayz website, an agent from their company approached me via whatsapp to understand my needs and guide with my booking. I booked a room in one of their properties in gurgaon (Sector **). Initially I had planned on staying for a longer duration but later decided on a shorter stay. Hence while filling the company's KYC form provided by the caretaker of the property during the move-in I opted in for an "Ultra-Short Stay" ( less than ** days) option in their form. I paid them (Rs.**** (booking charge & rent for remaining days in the month I moved in)+ Security deposit (*****). The security deposit is a refundable charge but it requires a ** day notice period. Hence, I even confirmed with the caretaker that choosing an ultra-short stay would not lead to any problem in the refunding my security deposit as they require a ** days notice period before moving-out.
And so when I moved out of their property I emailed to their company's support email regarding my move and requested a refund of my security. I received no reply from them. Later I got in contacted the company's agent who got in touch with me while booking the room and explained her the situation. She asked to drop an email as well and wait for ** days as that is the standard time taken for the refund. But even after ** days I didn't receive my refund and all my emails were also ignored. And the agent also ignored my calls and messages for a week. After a week of continuously trying to get in touch with the agent she replied to my message saying I will not be refunded as I did not give a ** days notice before moving out. I pointed out that I had chosen a less than ** days stay which makes it practically impossible for me to give a **-day notice. To this she just tried to dodge the conversation and only blamed me that I should've have given a ** days notice period and that she wasn't aware that I was choosing an Ultra short stay and that it was against company policies. I decided to mail the company with everything that happened but did not receive any reply.
It has been over ** days since I have moved out of that property but I still haven't received my refund. Moreover the company has been nothing but irresponsible and ignorant towards this whole situation. My arguments are that since I had opted for an ultra-short stay it is impossible for me to give a ** day notice period. And if I was not allowed to pick that option then why was it available in the form they provided me. It was negligence on their part. And even if I was initially planning for a longer stay, I had only communicated this verbally and informally. And their own company policies state that verbal communication is not valid. And my choosing an ultra-short stay in the form supersedes anything I may have communicated earlier as my final intentions were communicated via the option I chose in the form. Hence, I believe that I am entitled to my security deposit and the company has no right to withhold it. Any suggested "violation" of their policies have only been caused due to their own negligence and I personally haven't broken any policies.
