- New Car damaged during shifting ^Closed

I handed over my car (Mahindra Thar) # ********** to Agarwal Packer and Movers (DRS group) branch office at Nashik, Maharashtra on **.**.**** to be shifted to my home in Greater Noida. Their regional manager Mr. Ramesh rec’d the car in excellent and clean condition vide GC # ******* and assured to be loaded in carrier same night. Despite of repeated follow up, I got information from Mr. Ramesh that my car has been loaded into carrier (NL**-****) on **.**.**** at *:** PM. I have been tracking the shipment regularly and observed that car carrier reached Gurgaon hub on **.**.****. I received a call from Mr. Satish Tanwar from APM Gurgaon hub on **.**.**** that my car has reached there in damaged condition. He shared photographs with me. I was deeply shocked to see the condition of my new car. It was badly damaged. Mr. Satish could not tell me the reasons of damages and asked me to contact Mr. Ramesh in Nashik branch. I called Mr. Ramesh and asked him what happened to my car. He said sorry but my car was toppled due to rough driving by his driver in Nashik. My car was unauthorizedly driven by their Nashik branch staff between **.**.**** to **.**.**** and damaged due to rash driving by unskilled person. Instead of informing me regarding this accident, their Nashik team intentionally loaded damaged car into carrier. I called Mr. Sunil Chauhan (General manager) of Agarwal Packers and Movers (Sahibabad regional office) also and briefed the incident. He assured me that proper support will be provided by Agarwal Packers and Movers and my car will be repaired through authorised service center. With deep grief, anger and shock, I rushed from Nashik to Gurgaon on **.**.****. Mr. Satish Tanwar asked me to reach Gurgaon hub on **.**.****. • I alongwith Mr. Satish Tanwar took the car to Mahindra service center in Gurgaon where the body shop manager explained some complexity in claiming from insurance agency. I visited their regional office at Sahibabad on **.**.**** to discuss further action plan. Mr. Sunil Chauhan has committed that a wayout will be explored and Agarwal Packer and Movers will take full ownership to get my car fully repaired through professional authorised service centre through insurance claim agency. In worst case scenario, if any obstacle will be there, Agarwal Packers and Movers will bear all expenses of repair and delivery on my car in original condition. I came Nashik to attend my job. Now after * days of last meeting, I am not getting responses of my emails, whatsapp messages, Text messages and calls. I have lodged my complaints on their claim portal also but no response.
I need my car to be repaired through authorised service agency of Mahindra in satisfactory and original condition. I need compensation against NCB loss, Resale value loss and expenses occurring in using cab during this period of without car. Need compensation against the mental trauma faced during this period.
