I clearly reached out to you guys within the TIMELINE I need replacement or refund asap Within ** hours I am reaching out to District Consumer Disputes Redressal Commission

Please find attached copy of Samsung service center and the issue of the device and purchase of mine

*. Facts of the Case

I purchased a Samsung Galaxy Z Fold * from Flipkart under Order ID OD****************** delivered on ** December ****.
The product was advertised as new, but upon inspection and confirmation from Samsung Service Center, it was found to be a refurbished device, originally sold over ** months ago.
This constitutes misrepresentation, unfair trade practice, and deficiency in service under the Consumer Protection Act, ****.


*. Attempts to Resolve

I contacted Flipkart support multiple times, but no resolution was provided within the stipulated time.
Samsung confirmed the device is not new and advised me to escalate legally.


*. Demand

I hereby demand a full refund of ₹****** along with return arrangements, within * days of receipt of this notice.
Failure to comply will compel me to initiate proceedings before the District Consumer Disputes Redressal Commission, claiming refund, compensation for mental agony, and litigation costs.


*. Legal Basis

Sections *(*)(r) and *(*)(g) of the Consumer Protection Act, **** define unfair trade practice and deficiency in service.
Flipkart, as an e-commerce entity, is bound by Consumer Protection (E-Commerce) Rules, ****.
