Respected Sir/Madam,
I, Patruni Sastry, a resident of Manikonda, Hyderabad, Telangana, am constrained to approach this Hon’ble Commission under the provisions of the Consumer Protection Act, ****, seeking redressal against the continuous harassment, deficiency in service, and unfair trade practices carried out by M-Pockets, along with the failure of my telecom service provider, Airtel, to effectively safeguard my rights as a consumer.
It is submitted that I have been repeatedly receiving unsolicited calls and communications from representatives claiming to be associated with M-Pockets in relation to an alleged loan or financial obligation concerning a third party. I state unequivocally that I have never availed any service, loan, or financial facility from the said entity, nor have I, at any point, provided consent for the use of my mobile number or personal information in connection with their services. Despite clearly informing the callers on multiple occasions that my number has been wrongly associated and that I have no connection to the matter, the calls have persisted in a manner that is intrusive, coercive, and mentally distressing.
The actions of M-Pockets amount to gross negligence, unauthorized use of personal data, and harassment, thereby constituting an unfair trade practice and deficiency in service under the Consumer Protection Act, ****. The continued misuse of my personal information also infringes upon my fundamental right to privacy and dignity.
Furthermore, despite being a subscriber of Airtel, I have not received adequate protection or resolution against such unsolicited and harassing communications. The failure of the telecom service provider to effectively prevent or curb such repeated violations reflects a deficiency in service and non-compliance with the regulatory framework laid down by the Telecom Regulatory Authority of India (TRAI) concerning unsolicited commercial communications.
Due to the persistent nature of these calls, I have suffered considerable mental harassment, anxiety, and invasion of privacy, for which both the service provider and the offending entity are liable.
In view of the above, I respectfully pray that this Hon’ble Commission may be pleased to direct the opposite parties to immediately cease all forms of communication with me, to permanently delete my personal data from their records, and to ensure that no further harassment is caused. I further seek appropriate compensation for the mental agony and inconvenience caused, along with any other relief deemed fit in the interest of justice.
I am prepared to submit all necessary call records, screenshots, and supporting documents as evidence in support of my complaint.
This complaint is filed in good faith and in the interest of protecting my rights as a consumer.
