Subject: FINAL REJECTION OF RESOLUTION & ACCUSATION OF GROSS HARASSMENT (Complaint No: ******** / IRDAI Token: **-**-******)
Complaint Description:
I, Sonia Sahni, representing the **-year-old policyholder Mrs. Bharti Sahni, hereby serve this final rebuttal. At the very outset, I DEMAND AN IMMEDIATE CALL BACK FROM THE HIGHEST OFFICE OF BAJAJ ALLIANCE AND THE RSA HEADQUARTERS. My family has endured the trauma of losing my Father and Brother to Cancer. To be subjected to this level of corporate fraud and mental HARASSMENT by a company we have served for ** years is beyond inhumane. Your scripted "thorough evaluation" is a blatant lie to cover up the criminal negligence of your RSA agents.
LEGAL VIOLATIONS & ARTICLES INVOKED:
Consumer Protection Act, **** (Section *(**)): Gross "Deficiency in Service" and "Unfair Trade Practice."
IPC Section ***: Criminal Breach of Trust by the RSA agents.
IPC Section ***: Cheating and dishonestly inducing delivery of property (trying to force a towing bill).
IPC Section ***: Mischief causing damage to the amount of fifty rupees or upwards (intentional tampering with the vehicle).
IPC Section ***: Act endangering life or personal safety of others (leaving a patient in a tampered car with AC ON).
THE FACTUAL CHRONOLOGY OF SABOTAGE (DAY * TO DAY *):
DAY * (ELECTRICAL TAMPERING & FATAL RISK): Agent Amir arrived with a dead, rusted battery and falsely declared "Battery Failure" without a multimeter. He opened the internal fuse box and pulled out * plugs/relays of my German-engineered Volkswagen Polo without permission. I (an Osteoarthritis patient) was forced to steering while HE SAT INSIDE WITH THE AC ON FOR OVER AN HOUR, purposefully draining the system.
FATAL RISK: This fiddling created a massive risk of a SHORT CIRCUIT or FATAL ELECTRIC SHOCK. Is Bajaj Allianz waiting for a life-threatening disaster to take responsibility?
DAY * (INTENTIONAL SABOTAGE & UNAUTHORIZED TRESPASS): The agent visited and intentionally left the HEADLIGHTS AND CABIN LIGHTS ON, abandoning the car unlocked on a public road to ensure the battery died. Despite my complaint to the escalation desk (Mr. Amar), the agent REVISITED WITHOUT ESCALATION TEAM PERMISSION. He was CAUGHT RED-HANDED BY NEIGHBORS opening the bonnet and tampering with battery terminals and wiring.
DAY * (THE FRAUD EXPOSED): A professional Multimeter check confirmed **.**V (Healthy Battery), proving that your agents claims were a total scam to generate fraudulent towing revenue.
STRICT DEMAND FOR POINT-WISE WRITTEN REPLY & EVIDENCES:
I demand a point-wise written reply supported by evidence on these * grounds. Do not provide generic scripts:
PROOF OF DIAGNOSIS: Provide the clause that allows a "Battery Fault" declaration WITHOUT A MULTIMETER. My independent reading was **.**V. Prove that guesswork is an authorized RSA protocol.
FUSE BOX & ELECTRIC SHOCK RISK: If diagnostics are "not allowed," why did your agent pull * plugs/relays? Who would be liable if a fatal electric shock had occurred due to this fiddling?
AC DRAIN & ENDANGERMENT: Justify why an RSA agent was allowed to leave the AC ON for an hour during a service call for a "low battery." Why was an Osteoarthritis patient forced into high-risk maneuvers?
INTENTIONAL DAMAGE (HEADLIGHTS): Justify why your agent left a car with HEADLIGHTS ON and abandoned it. Is this "assistance" or "intentional sabotage"?
UNAUTHORIZED REVISIT REPORT: Provide the Action Taken Report against the agent for his revisit without escalation team permission and terminal tampering witnessed by neighbors.
COMPENSATION CRITERIA: If this systematic sabotage, risk to life, and HARASSMENT do not meet your criteria, ON WHAT GROUNDS DO YOU ACTUALLY GIVE COMPENSATION?
